There are different annual obligations of information on the possession of goods and rights located abroad, which must be completed before different administrations.
The obligations, in order of maturity, are specified below:
ETE FORM
– Economic transactions and balances of financial assets and liabilities abroad are reported if they exceed the total amount of one million euros.
-It is presented to Banco de España.
-The deadline for filing the 2024 tax return ends on 01-20-2025.
It is necessary to remember that for the presentation of the ETE Form it is essential to have an electronic ID, by means of an electronic certificate or through the electronic ID.
FORM D-6
– Declaration of holders of Spanish investment abroad in negotiable securities, if the amount of the investment exceeds 10% of the capital of the listed company (significantly reducing the number of investors obliged to declare).
-It must be submitted to Ministerio de Economía.
-The deadline for filing the 2024 tax return ends on 01-31-2025.
FORM 720
-Informative declaration on assets and rights located abroad (real estate, investment funds, current accounts, insurance policies…) provided that they exceed 50,000 euros on an individual basis, or those assets and rights already reported previously that suffer a variation of 20,000 euros.
-Must be submitted to the AEAT
– The deadline for filing the 2024 tax return is 03-31-2025.
If you consider that you may be obliged to submit any of these forms, it will be necessary to request the following information from the foreign banks’ depository of the assets:
- Extract of the movements recorded by current, savings, time or similar accounts, from 01-01-2024 to 31-12-2024.
- Equity position of the portfolio of accounts and securities as of 31-12-2024.
- List of purchase and sale movements of financial assets produced from 01-01-2024 to 31-12-2024.
- Any form, report, report or equivalent disseminated by the entity for the purpose of preparing the aforementioned statements.
